The following Terms and Conditions govern the use of the website www.prakerja.go.id ('the Website'). Users are advised to read these terms carefully as they may affect the rights and obligations of the Users under the law.

Users must be at least 18 (eighteen) years old and not under guardianship or custody in order to have the legal capacity to bind themselves to these Terms and Conditions. If Users do not meet these requirements, any legal actions taken by Users to access the Website, use the Website, and/or register for the Program Kartu Prakerja through the Webite, or engage in any other activities on the Website, must be done with the knowledge, supervision, and valid consent of their parents or legal guardians. Parents or legal guardians who provide consent for Users under 18 (eighteen) years old are fully responsible, legally, for all actions taken by the Users in accessing, using, and/or registering for Program Kartu Prakerja through the Website.

By registering and/or using the Website www.prakerja.go.id, Users are deemed to have read, understood, comprehended, and agreed to all the contents of the Terms and Conditions. These Terms and Conditions constitute a legally binding agreement between the Users and the Project Management of Program Kartu Prakerja ('Project Management'). If Users do not agree with any, some, or all of the contents of the Terms and Conditions, they may discontinue the use of the services on the Website.

  1. 1. Definition

    1. Program Kartu Prakerja is a workforce competency development program aimed at job seekers, workers who have experienced job termination, and/or workers who require skills enhancement.

    2. Kartu Prakerja is a card that serves as an identification for beneficiaries of Program Kartu Prakerja.

    3. The Project Management is the unit responsible for implementing Program Kartu Prakerja.

    4. The Website is www.prakerja.go.id.

    5. The Terms and Conditions are an agreement between the User and the Project Management, which contains a set of provisions that govern the rights, obligations, and responsibilities of the User and the Project Management, as well as the procedures for using the Website.

    6. The Privacy Policy is the privacy policy issued by the Project Management and can be accessed at www.prakerja.go.id/kebijakan-privasi.

    7. The User refers to the party who accesses and/or uses the Website, including but not limited to individuals who have an Account on the Website, registrants, prospective registrants, Kartu Prakerja Beneficiaries, or any other party who simply visits the Website.

    8. Training Aid refers to cashless aid in the form of digital balance on the Digital Platform, which is provided to Kartu Prakerja Beneficiaries for the purpose of attending Trainings.

    9. Training refers to a comprehensive set of activities aimed at acquiring, improving, and developing Work Competencies, productivity, discipline, work attitude, and work ethic at a specific skill and expertise level. These activities are organized by Training Institutions.

    11. Training Institutions refer to the entities authorized by Program Kartu Prakerja to conduct the Training and collaborate with the Digital Platform.

    12. The Digital Platforms are official government partners in the implementation of the Program Kartu Prakerja, utilizing applications, websites, and/or other internet-based content services.

    13. An Account is a registered account created by the User on the Website.

    14. Kartu Prakerja Registration is the registration process conducted by the User on the Website to apply for the incentives or Training Aid from Program Kartu Prakerja.

    15. The Test is a mandatory aptitude and motivation test that Users must take to complete in order to meet the requirements for Kartu Prakerja Registration.

    16. Batch Selection refers to the evaluation and selection process that determines the eligibility of applicants for Kartu Prakerja Registration based on specific regions, periods, and allocated quotas.

    17. Incentives are additional benefits provided to Kartu Prakerja Beneficiaries in the form of a specified amount of money, disbursed through a bank account or electronic money(e-money).

    18. The Committee refers to the Job Creation Committee established by the President to oversee the implementation of Program Kartu Prakerja.

    19. Content refers to all information, linked pages, features, data, text, images, photos, graphics, music, sound, videos (including live streams), messages, tags, content, programming, software, application services (including, but not limited to, any mobile application services), or other materials available through the Website.

    20. Intellectual Property refers to all exclusive Content, trademarks, service marks, brand names, logos, industrial designs, patents, and other intellectual property rights.

    21. Evaluation Survey is a survey conducted by the Project Management to assess the effectiveness of Program Kartu Prakerja among the beneficiaries.

    22. Training Certificate is a written proof provided by the Training Institution to participants who have successfully completed and/or finished the Training.

  2. 2. Registration of Account and Participant for Program Kartu Prakerja

    1. By accessing the Website, using the Website, and/or registering for Program Kartu Prakerja through the Website, the User hereby declares that they are legally capable and competent to enter into a valid agreement. Users who are not legally capable and competent to enter into a valid agreement in accordance with the law, in accessing the Website, using the Website, and/or registering for Program Kartu Prakerja through the Website, or engaging in any other activities on the Website, hereby declare that all such actions are taken with the knowledge, supervision, and lawful consent of their parent, guardian, or legal custodian.

    1. Prior to using the Website, Users agree to comply with these Terms and Conditions and the Privacy Policy (as further explained in Point 8 of these Terms and Conditions).

    1. To proceed with the registration for Kartu Prakerja, Users are required to first create an Account on the Website. To avoid any ambiguity, the Project Management does not collaborate with any third party in the registration process for Kartu Prakerja.

    1. The Account registration must use the User's active email and/or mobile phone number that will remain unchanged for a minimum of 5 (five) months.

    1. If the User intends to receive the Incentives through electronic money payment system as mentioned in Point 6 below, the User must use the same mobile phone number registered on the Account.

    1. During the Account registration process, the User is required to provide their personal data, which includes, at a minimum, (i) full name, (ii) national identification number on the electronic identity card, (iii) family card number, (iv) date of birth, (v) email address, (vi) mobile phone number, (vii) mother's full name, (viii) residential address as stated on the identity card, (ix) gender, (x) highest education level, (xi) employment status, and (xii) marital status, (xiii) number of dependents, (xiv) occupation, (xv) preferred training topics, and (xvi) a photo of the identity card.

    1. During the registration process on Kartu Prakerja Website, the User is required to use their legal name and personal data that matches their valid identification card (Kartu Tanda Penduduk). The User is also required to complete facial verification in accordance with the guidelines set by the Project Management.

    1. Once registered, the User's name as stated on their identification card (Kartu Tanda Penduduk) cannot be modified or substituted with another individual's name.

    1. The User is required to provide accurate data and information on the Website, and is prohibited from providing false data or information, as well as manipulating or forging data. The User understands that providing false data or information may be considered an unlawful act that can result in legal consequences, both civil and criminal, as regulated in, but not limited to, the Criminal Code and Law Number 11 of 2008 concerning Electronic Information and Transactions.

    1. Users must have a registered account on the Website in order to proceed with the Kartu Prakerja registration and participate in the Batch Selection.

    1. The Project Management does not charge any registration fees to Users.

    1. Users are prohibited from creating and/or using devices, software, features, and/or other tools intended to manipulate the Project Management's system, including but not limited to: (i) manipulating Account data; (ii) crawling/scraping activities; (iii) automation in registration, use of Training Assistance, and/or purchase of Training; and/or (iv) any other activities that can reasonably be considered as system manipulation.

  3. 3. The selection of Kartu Prakerja Beneficiaries

    1. The registration for Kartu Prakerja will undergo a verification and selection process by the Project Management in accordance with the regulations, policies set by the Committee, and/or the standard operating procedures established by the Project Management.

    2. After completing the Registration for Kartu Prakerja, Users may proceed to participate in the Batch Selection on the Website.{' '} The Test questions are strictly confidential and must not be distributed or shared with others..

    3. Users who have participated in the Batch Selection will undergo verification and selection by the Project Management to be determined as Beneficiaries of Kartu Prakerja.

    4. Kartu Prakerja Beneficiaries, as referred to in Section 3.3, will be issued a digital Kartu Prakerja consisting of a 16-digit number.

    5. The Project Management has the authority to approve or reject the registration of Kartu Prakerja for each User.

  4. 4. Training Aid

    1. The Committee has the authority to determine the amount of Training Aid for Kartu Prakerja Beneficiaries.

    2. The approved Training Aid will be disbursed as a cashless balance in the virtual account of Kartu Prakerja Beneficiaries. This balance can be utilized by the Beneficiaries to make payments for one or more Training programs through the Digital Platforms.

    3. The Training Aid can be utilized by Kartu Prakerja Beneficiaries once they have successfully linked their bank account or(e-money)provider to the dashboard of the website.

    4. Without disregarding the obligations stated in Point 5.4, it is mandatory to fully utilize the Training Aid by the end of the current fiscal year, specifically by November 30th. In the event that a Kartu Prakerja Beneficiary does not utilize the entire Training Aid by the specified date, the remaining amount will be refunded to the state treasury account.

    5. The Training Aid provided to Kartu Prakerja Beneficiaries cannot be converted into cash and cannot be used to purchase Training programs that exceed the value of the Training Aid.

    6. The Training Aid provided to Kartu Prakerja Beneficiaries is strictly for their own use and cannot be utilized by any other individuals apart from the intended Beneficiaries.

    7. Kartu Prakerja Beneficiaries are strictly prohibited from transferring, selling, giving, or in any way transferring their Kartu Prakerja and/or Training Aid to another party.

  5. 5.Kartu Prakerja Users on Digital Platforms

    1. Once the registration for Kartu Prakerja is approved and the Beneficiaries receive confirmation of the Training Aid amount, they will receive a digital Kartu Prakerja. The Beneficiaries can then use Kartu Prakerja as a payment method to purchase or pay for one or more Training through the Digital Platform.

    2. Kartu Prakerja Beneficiaries can only use Kartu Prakerja to purchase or pay for Trainings offered by partner institutions on the Digital Platform.

    3. Kartu Prakerja Beneficiaries can only use Kartu Prakerja to purchase or pay for training programs according to the approved amount of the Training Aid.

    4. A Kartu Prakerja Beneficiary is required to make the first purchase of a Training no later than 15 (fifteen) calendar days after receiving the notification of being selected as a Kartu Prakerja Beneficiary from the Project Management. Failure to make the purchase within this specified period will result in the cancellation of their participation.

    5. In the event that the participation of a Kartu Prakerja Beneficiary is revoked:

      • Any remaining Training Aid in Kartu Prakerja will be returned to the state treasury.
      • Any remaining Incentive in Kartu Prakerja will be returned to the state treasury.
      • The Beneficiary will not be eligible to participate in Program Kartu Prakerja again.
    6. A Kartu Prakerja Beneficiary is required to choose and purchase the next Training within a period of 15 (fifteen) calendar days after completing the previous Training and provide a review and evaluation of the last Training. Failure to select and purchase the Training within the specified timeframe will result in the remaining Training Aid in Kartu Prakerja being refunded to the state treasury

    7. Kartu Prakerja Beneficiary hereby declares and assures that the use of Kartu Prakerja under their name on the Platform Digital will only be utilized for their personal use and not for any other party.

    8. The utilization of Kartu Prakerja to purchase or pay for training fees on the Digital Platform is considered successful once the Kartu Prakerja Beneficiary has received a notification or proof of successful transaction confirmation from the Digital Platform.

    9. A Kartu Prakerja Beneficiary is responsible for keeping the security of the confirmation proof of successful transactions as referred to in Point 5.7 above, and ensuring that such confirmation proof is not used by others and/or transferred to third parties.

    10. A Kartu Prakerja Beneficiary is required to provide or submit the confirmation proof of successful transactions as referred to in Point 5.7 above to the Training Institution in order to participate in training, whether it is conducted online or offline.

    11. A Kartu Prakerja Beneficiary is required to participate in and complete each Training purchased using Kartu Prakerja according to the scheduled time and location of the Training that has been chosen, without being represented by someone else.

    12. In the event that a Kartu Prakerja Beneficiary fails to participate in and complete the purchased Training as per the terms and conditions set by the Training Institution, and if the said Training is the recipient's first Training:

      • The recipient will not be entitled to receive any Incentives.

      • The remaining Training Aid in Kartu Prakerja will be returned to the state treasury.

      • The recipient will not be eligible to participate in Program Kartu Prakerja again.

    13. The Project Management has the authority to close an Account, cancel registration approval, revoke Training Aid and/or Incentives, and/or cancel Training purchases by Users, either temporarily or permanently, if there are fraudulent activities in the registration process, Tests, Training purchases, Training attendance, and/or violations of these Terms & Conditions. Users acknowledge that the Project Management reserves the right to take any necessary actions in relation to these matters, including but not limited to rejecting new registration applications if duplicate data is found.

  6. 6. Incentives

    1. The Committee has the authority to determine the amount of Incentives for Kartu Prakerja beneficiaries.

    2. Incentives are provided to Kartu Prakerja beneficiaries who have completed the Training. Incentives consist of:

      • Job search expense Incentive; and

      • Evaluation Survey Incentive.

    3. The Incentives mentioned in Point 6.1 are utilized for the purpose of:

      • Alleviating job search expenses and/or living costs; and

      • Evaluating the effectiveness of Program Kartu Prakerja.

    4. The job search expense Incentive is granted to Kartu Prakerja Beneficiaries who have fulfilled the criteria established by the Project Management, which include:

      • Completed a Training Program and obtained a Training Certificate. To avoid any ambiguity, if a recipient has participated in more than one Training Program, the job search expense Incentive will only be given after completing the first Training Program and providing a rating and review for the first Training Program; and

      • Provided rating and review for the Training Program.

    5. The Evaluation Survey Incentive is granted to Kartu Prakerja Beneficiaries who have completed the Evaluation Survey according to the provisions set by the Project Management.

    6. The Incentives will be transferred to the bank account or electronic money provider (e-money) that has been linked by Kartu Prakerja Beneficiary on the Website, according to the schedule set by the Project Management.

    7. The identification number (NIK) on the bank account or e-money (e-money) as referred to in Point 6.4 must match the identification number used during the Account registration process and must be under the name of Kartu Prakerja Beneficiary.

    8. A Kartu Prakerja Beneficiary is required to use the same mobile phone number that is linked or registered with the e-money provider for the disbursement of Incentives (if chosen), which should match the verified mobile phone number used during the Account registration process as mentioned in Point 2.5 above.

    9. In addition to the provisions stated in these Terms & Conditions, a Kartu Prakerja Beneficiary is also subject to the terms and conditions governing the legal relationship between Kartu Prakerja Beneficiary and the bank where they hold a bank account and/or the e-money provider of each respective Beneficiary. The Project Management shall not be held responsible for any consequences that may arise from the legal relationship between Kartu Prakerja Beneficiaries and the bank where they hold a bank account, and/or the entity operating the e-money payment system of each respective Beneficiary.

  7. 7. Password and Security

    1. The User is personally responsible for maintaining the confidentiality of their Account and password for all activities that occur within their user Account.

    2. The Project Management will never request the User's password, verification code, or OTP (One-Time Password) for any purpose. It is strongly advised that Users refrain from sharing such information or any other sensitive data with individuals claiming to represent the Project Management, the Government, or any other party whose security cannot be ensured.

    3. The User acknowledges the importance of logging out from their Account at the end of each session on the Website and agrees to promptly inform the Project Management in the event of any unauthorized use of their password or Account.

    4. The User hereby acknowledges that the Project Management is not responsible for any losses or issues arising from the misuse of the User's Account due to the User's negligence. This includes, but is not limited to, lending or granting access to the Account to others, accessing links or URLs provided by others, sharing or revealing verification codes (OTP),

  8. 8. Use of Personal Data or Information

      The Project Management collects information that identifies or can be used to identify, contact, or locate individuals associated with that information in accordance with the Privacy Policy. The acquisition, collection, processing, analysis, storage, display, use, and sharing of personal information provided by Users during the Kartu Prakerja registration process are subject to the Privacy Policy, which is an integral part of these Terms and Conditions.

  9. 9. Intellectual Property Rights

      All Intellectual Property displayed on the Website belongs to the Project Management, unless otherwise specified and identified as the Intellectual Property of third parties on the Website. No rights or licenses are granted, directly or indirectly, to Users or any other party accessing the Website, to use or reproduce the Intellectual Property. No party accessing the Website shall claim any rights, ownership, or interests therein. By using or accessing the Website, Users agree to comply with all applicable copyright laws, trademarks, service marks, and all other relevant laws protecting Program Kartu Prakerja, the Website, its Content, and Intellectual Property. You agree not to copy, distribute, republish, transmit, publicly display, modify, adapt, create derivative works from any part of Program Kartu Prakerja, the Website, its Content, or Intellectual Property. Without the prior written consent of the Project Management, you may not duplicate any portion or the entirety of the Content or Intellectual Property contained on this Website on any other server or as part of any other Website. Furthermore, you agree not to use any robot, spider, software, or other automated or manual processes to monitor or copy the Content owned by the Project Management without the prior written consent of the Project Management.

  10. 10. Force Majeure

      In the event of an occurrence or event beyond the authority or control of the Project Management, including but not limited to natural disasters, war, riots, system hacking, sabotage, fire, power outages, and/or telecommunication disruptions, government policies related to Program Kartu Prakerja and/or the Website, and other events that result in the interruption of services through the Website and/or the interruption of Program Kartu Prakerja implementation, Users agree to release the Project Management from any claims and liabilities if the Project Management is unable to facilitate the implementation of Program Kartu Prakerja, including fulfilling the instructions given by Users on the Website, whether partially or entirely, due to a Force Majeure event.

  11. 11. Legal Action

      The Project Management has the right to conduct inspections and/or pursue legal action against any violations of the provisions in these Terms and Conditions, including by involving and cooperating with relevant authorities. The User agrees that the Project Management has the right to take legal actions against Users who violate any provision of these Terms and Conditions, with the purpose of operating the Website, ensuring User compliance with these Terms and Conditions, or complying with applicable laws, court decisions, administrative institutions, or other government bodies. If a User violates any provision of these Terms and Conditions and the Project Management does not take immediate action, it does not imply that the Project Management waives its right to take necessary action in the future.

  12. 12. Legal Provisions and Dispute Resolution

      The agreement set forth in these Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia. The User agrees that any legal actions or disputes arising from, related to, or in any way connected with the Website and/or these Terms and Conditions shall be exclusively resolved within the jurisdiction of the courts of the Republic of Indonesia. For the purpose of resolving any disputes or differences of opinion or issues that may arise from these Terms and Conditions, the User and the Project Management agree to select a common and unchanging legal domicile at the office of the clerk of the Central Jakarta District Court in Central Jakarta, and any and all disputes arising from these Terms and Conditions and/or the use of the Website shall be subject to the exclusive jurisdiction of the Central Jakarta District Court.

  13. 13. Modifications and Renewals

      The Project Management may make changes and/or updates to the Terms and Conditions from time to time for legal and regulatory reasons, or to ensure the proper and smooth operation of the Website, without prior notice. Users are required to carefully read and review this Terms and Conditions page from time to time to be aware of any changes. By continuing to access and use the Website and/or the services provided by the Project Management on the Website and/or Kartu Prakerja, Users are deemed to have agreed to be bound by the changes in the Terms and Conditions.

  14. 14. Additional Terms

    1. Users are prohibited from transferring their rights under these Terms and Conditions without obtaining prior written consent from the Project Management.

    2. These Terms and Conditions shall remain valid following a temporary suspension, permanent suspension, deletion of the Website, and/or the termination of these Terms and Conditions.

    3. The User agrees to waive any right to make any claims or objections regarding the validity of these Terms and Conditions or the Privacy Policy.

    4. If any provision of these Terms and Conditions contradicts the applicable laws and regulations, the provision that aligns with the laws and regulations shall take precedence over the conflicting provision.

    5. If any provision of these Terms and Conditions is found to be invalid or unenforceable, it shall not render the other provisions invalid or unenforceable.
